Terms of Service

Welcome to buyselldiva.com (the “Site”), operated by Beth Mckeone and James “Griff” Griffis in connection with VantaSure Realty (collectively, “we,” “us,” “our,” or “Buy Sell Diva”). These Terms of Service (the “Terms”) govern your access to and use of the Site, our forms, our newsletters, our drip email sequences, and any account you create on the Site.

By using the Site, submitting a form, subscribing to our emails, or creating an account, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who We Are

Buy Sell Diva is the real estate practice of Beth Mckeone (FL License #3435994) and James “Griff” Griffis (FL License #SL3473163), licensed Florida real estate professionals working under VantaSure Realty. Nothing on this Site creates a broker, agent, fiduciary, or client relationship until a written representation agreement is signed.

2. Information Accuracy & Your Duty to Verify

The Site includes information about homes for sale, neighborhoods, school districts, market statistics, HOA details, taxes, square footage, flood zones, and similar topics. Much of this information comes from third-party sources including the local MLS, public records, and data providers.

We believe the information on this Site is correct at the time it is published, but we do not guarantee its accuracy, completeness, or timeliness. Listing status, price, availability, square footage, lot size, taxes, fees, and features change constantly and may contain errors.

It is your responsibility to independently verify any fact that is material to your decision before acting on it. This includes, but is not limited to, confirming property details with the listing agent, title company, municipality, school district, HOA, lender, and licensed inspectors. Nothing on this Site should be treated as legal, tax, financial, appraisal, or inspection advice.

3. Using the Site

You agree to use the Site only for lawful, personal, non-commercial purposes. You agree NOT to:

• Scrape, crawl, copy, or bulk-download listing content, images, or market data.
• Re-publish, re-sell, or redistribute content from the Site without our written permission.
• Interfere with the Site's operation, security, or other users' access.
• Submit false information through any form or account.
• Use the Site to harass, spam, or solicit other users or agents.
• Attempt to reverse engineer, decompile, or access non-public areas of the Site.

4. Lead Forms, Newsletters & Drip Emails

When you submit a contact form, lead form, home valuation request, or newsletter signup, you understand and agree that:

• You are giving us permission to contact you by email, phone, or text about your inquiry and about real estate services that may interest you.
• You may be enrolled in an automated drip email sequence (for example, a buyer onboarding series or a listing alert series) relevant to what you asked about.
• You can unsubscribe at any time via the link in the footer of any marketing email, or by replying “STOP” to any text. See our Privacy Policy for full details.
• By providing a phone number, you consent to calls and texts (including automated ones) from Beth, Griff, or our team. Consent is not a condition of any purchase and message/data rates may apply.

5. Site Accounts

The Site may offer, or in the future offer, the ability to create a user account to save searches, favorite listings, track home values, and receive tailored alerts. If you create an account, you agree that:

• You are at least 18 years old and legally able to enter into these Terms.
• The information you provide is accurate and kept up to date.
• You are solely responsible for keeping your password confidential and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.
• Your account is for personal, non-commercial use only. You may not share, transfer, or resell your account.
• We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, misused the Site, or attempted to circumvent MLS or licensing rules.
• You may close your account at any time by calling us at 954-300-1057.

6. Intellectual Property

All content on the Site — including the Buy Sell Diva name and logo, written copy, photography, videos, games, and layouts — is owned by us or our licensors and is protected by copyright, trademark, and other laws. Listing data and photos accessed through IDX or MLS feeds are owned by the listing brokers and the local MLS and are subject to the MLS's terms of use.

You may view and print Site content for personal, non-commercial use only. Any other use requires our prior written permission.

7. Third-Party Links & Services

The Site may link to third-party websites, lenders, title companies, mortgage calculators, or tools. We provide these for convenience only and do not control, endorse, or take responsibility for them. Your use of any third-party site is at your own risk and governed by that site's own terms.

8. Fair Housing

Buy Sell Diva and VantaSure Realty fully support the Fair Housing Act and the Equal Credit Opportunity Act. We do not discriminate based on race, color, religion, sex, familial status, national origin, disability, sexual orientation, gender identity, or any other protected class.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF LISTING OR MARKET DATA. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, BUY SELL DIVA, BETH MCKEONE, JAMES GRIFFIS, VANTASURE REALTY, AND OUR RESPECTIVE AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INFORMATION ON IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless Buy Sell Diva, Beth Mckeone, James Griffis, and VantaSure Realty from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site after any change means you accept the updated Terms.
